May 5 : MJ Fan vs Sony/Estate lawsuit: The saga continues.

June 24 : The Michael Jackson Estate sue Jeffre Phillips

Michael Jackson’s estate claims Jeffre Phillips once engaged to LaToya Jackson used the chaos and sadness around Michael’s death to steal a bunch of property from the home where Michael Jackson was murdered.
According to new legal documents, the Estate claims Jeffre Phillips apparently used his 9-day stay in Michael’s Carolwood House to steal personal and private property.
Michael’s estate claims Phillips started staying at the home right after MJ died on June 25, 2009 and pulled off brazen acts of theft under the cover of all the hullabaloo around the home … making off with items including MJ’s iPhone, California drivers license, prescription pill bottles with pills inside and some clothes.
The Estate claims Phillips also stole handwritten notes from MJ, plus a briefcase filled with personal and business papers, as well as video cameras, computers and hard drives and even stole the pajamas Michael was wearing in the final hours before his death — which had apparently been removed from his body by the paramedics trying to save his life — and a resuscitator tube that appears to have been used on Michael. The lawsuit was filled on Friday 24 June 2022.

June 29 : The Cascio tracks removed from all music platforms

The infamous Cascio tracks that were on the first posthumous album of the King of Pop released in 2010, have been removed from some music platforms. The tracks “Breaking News”, “Keep Your Head Up”, and “Monster” seems to not appear on certain platforms anymore Vera Serova has been taking on Sony Music and the Estate of Michael Jackson in court for years after the release of the album which included the 3 disputed songs.

August 11 : Michael Jackson Estate & Sony Settle Lawsuit Over Cascio Tracks

August 13 : The Michael Jackson’s estate vs Jeffre Phillips saga continues! After the lawsuit was filled on Friday 24 June 2022 where Michael Jackson’s estate claims Jeffre Phillips used the chaos and sadness around Michael’s death to steal a bunch of property from the home where Michael Jackson was murdered. LaToya Jackon’s ex-fiancé Jeffré Phillips has told a judge he did not steal Michael’s private property in the days after his death. According to court documents, in his declaration, Phillips said the allegations are not true. He said from 1995 through 2015, he dated LaToya. “We were engaged to be married during the last one and a half years of our relationship. Throughout our relationship, we lived together, worked together, toured together, starred in our own reality show together and operated as a single-family unit.”

September 3 : First win for the Estate in “Michael Jackson Estate vs Jeffre Phillips”

Michael Jackson’s estate just scored a big legal win in the legal battle with Jeffre Phillips by preventing a potential sale of Michael’s property the estate claims was stolen from the singer’s home right after his death. According to new legal docs, a judge issued a preliminary injunction barring Jeffre Phillips from selling any items he allegedly removed from the residence back in 2009.

November 09 : The Michael Jackson Estate seeking to recover $1 million in property possessed by Jeffre Phillips.

The Estate launched legal actions last June when Julien’s Auctions reported Phillips’s attempt to sell the items to the Estate. Today, the Estate is seeking to recover $1 million in property the estate believes is being wrongfully possessed by Jeffre Phillips.

2023

February 8 : Michael Jackson Estate allegedly selling Michael’s catalogue

March 8 : Katherine Jackson will not be at Jeffre Phillips’ trial

March 11 : Michael Jackson Estate demand of transaction objected by Katherine Jackson

April 11 : The Michael Jackson Estate demands to be allowed to inspect the allegedly stolen property in the possession of Jeffree Phillips

April 18 : Last November, the Estate of Michael Jackson asked permission to the court to go ahead with a secret transaction. The court documents are sealed and non of us know what this is about but speculations point out to the selling of Michael’s catalogue. Last month, Katherine Jackson filled an objection to the transaction in question. Now the Estate led by John Branca, is asking the court to dismiss Katherine’s objections to the proposed transaction and to move forward with the deal in question. In their motion, the estate lays out how they turned Michael’s estate around. Branca and McClain said when they took over the pop star was drowning in debt. The estate said none of Michael’s children have raised issues with the deal. The executors argue Katherine should not be allowed to prevent the three beneficiaries from benefiting from the deal and they said that Katherine’s objections are “misplaced”.

May 23 : The dispute between the Michael Jackson Estate and Katherine Jackson regarding a secret deal is still on going. New court documents revealed that the Estate is fearing the legal opposition from Katherine Jackson might jeopardise the deal. “Given the amount of time that an appeal will take, almost certainly more than a year, it is unlikely that this deal will be on the table for the Executors to accept at the conclusion of appellate proceedings, Offer of this magnitude are not typically left open for months or years at a time, with no certainty that they will ever close. This is particularly true here since the economics of the deal necessarily change with the passage of time.”The filing noted that one family member’s objection is not that the deal is bad but rather the family member does not want to proceed with any such transaction of the kind. It seems that the whole secret deal is about the selling of Michael Jackson own music catalog. Both McClain and Branca claimed in court that the loss could be greater than $400 Million! The judge still have to take a decision on the matter.

May 28 : Following the Michael Jackson Estate demanding to inspect the allegedly stolen property in the possession of Jeffree Phillips, Jeffree will be turning over personal property owned by Michael Jackson to a third party to safeguard while he continues to fight the estate over claims he stole the items. Jeffree was ordered by the court to produce 109 CDs/DVDs, five hard drives, three silver-colored Apple Macintosh laptop computers, two iPods, two Dictaphones with two micro-cassettes and three standard cassette tapes. The property will be stored by a man named Kevin Singer. Singer is a specialist Court-Appointed Court Receiver and his role is to preserve assets where there is a dispute within a partnership or a company pending a decision on the matters of dispute. The Michael Jackson property will be in safe hands until the dispute is settled.

June 27 : Wade Robson’s case to go on trial

The California Court of Appeal just cleared the way for Robson to make his case in court. The trial court favoured the Estate’s argument, but the Court of Appeal begged to differ, and according to a tentative ruling the case will be sent back down for trial. Robson sued the MJ corporation in 2013 and The California Court of Appeal has reversed the 2021 decision dismissing his case. The case was originally dismissed in 2017 after a judge found it was filed past the statute of limitations. However, a new law extending the time for child victims to file legal claims revived the case in 2019. Then, in 2021, the judge ruled that Michael’s company had no legal duty to protect Robson from any alleged harm.

June 30 : LaToya Jackson, Michael’s sister and ex-fiance of Jeffre Phillips will be called as a witness according to the court documents. Phillips plans to use Latoya as part of his defense in the case. He claimed, “had the Estate simply asked for the property and not resorted to the premeditated set-up and bullying tactics, I would have called La Toya to inform her that the Estate was requesting the items, and the two of us would have then called her mother. If Ms. Jackson instructed me to give the property back to the Estate, I would have done so.”

July 19 : Jeffree Phillips, who is being sued by the Michael Jackson Estate over allegedly stolen items from Michael Jackson home just few days after his death, is asking the court to delay the trial to be able to build his defense.

Phillips has requested the sheduled trial date of September 6, 2023 to be pushed by 6 months as his lawyer still wants to depose Michael’s 93 year old mother Katherine along with the two co-executors of the Estate, John McClain and John Branca.

Phillips also said that he had to change lawyer and this new lawyer needs more time to catch up on the case. He even said that the extra time would allow the parties to continue settlement discussions.

August 18 : APPEALS UPDATE: Court Publishes Final Opinion – Unchanged from Tentative. The court has reversed both dismissals of Wade/James back to trial court. Based on the tentative and judge demeanor in oral arguments, this is no surprise. The litigants continue.

Statement from the estate on the appeal reversal : “…We remain fully confident that Michael is innocent of these allegations, which are contrary to all credible evidence and independent corroboration…motivated solely by money. We trust that the truth will ultimately prevail.”

September 07 : Within less than 24hrs, the court of appeal of the State of California has already denied the Petition for Rehearing deposited by the Michael Jackson Estate on September 05. The court appeal has denied the petition on September 06, meaning that they will not revise their decision for the Robson case to go to trial. However, fan experts in US laws are positive about this as it seems this was expected and planned by the Estate. The Estate’s plan is to go to the Supreme Court of the United States as this is the ultimate power decision in the US court system. The petition being denied will build their case for the Supreme Court and reverse the Appeal court decision.

September 26 : The Estate of Michael Jackson files petition to the Supreme court

The estate of Michael Jackson has just filed a 42-page petition seeking review from the California supreme court in the Robson/Safechuck case. The Estate hopes to that the Supreme court will reverse the court of appeal of the State of California that was denied at the beginning of the month. We will update you as soon as the Supreme Court issued an answer. The petition was filed on September 26, 2023.

October 05 : After a long and public exposure of the lawsuit between Jeffree Phillips and the Estate of Michael Jackson, both came to settlement.

“The litigation between the Estate of Michael Jackson and Jeffré Phillips has been amicably resolved without the need for a trial and without any findings or admissions of wrongdoing. Mr. Phillips has voluntarily returned Michael Jackson’s property to the Estate. All outstanding disputes between the parties have been settled on confidential terms. We wish Mr. Phillips well in his future endeavors. ” said Jonathan Steinsapir, counsel for the Co-Executors of the Estate of Michael Jackson.

Michael Jackson’s estate is no longer arguing with Jeffree who allegedly stole $1 million worth of MJ property from Michael’s Carolwood estate. The parties just told the court there’s a settlement.
According to new legal documents, Michael’s estate settled its legal dispute with Jeffré Phillips, who was accused of taking tons of Michael’s belongings in 2009, after the singer died.It is unknown if the pressure to make Katherine and LaToya Jackson testifying in this case has a play into the settlement.
The terms of the settlement are confidential, though it’s worth noting the Estate had been asking the judge to help return the property.

November 16 : The estate of Michael Jackson’s petition for review of the appeal’s reversal has been denied. The Robson/Safechuck case will therefore go to trial so brace yourself for another years of fighting for justice.

December 30 : According to court documents, Katherine Jackson, 93, is demanding the Michael Jackson Estate to pay $561,548 for her legal fees, fighting against the secret deal the Estate is planning. While her appeal is still ongoing in court, Katherine Jackson stated that the Estate was responsible for reimbursing her legal fees. Katherine said her law firm had to interview family members, gather documents, prepare exhibits for trial, prepare trial briefs, prepare witnesses, examine and cross-examine witnesses, and various other tasks. She said from April 1, 2023, to November 30, 2023, the law firm billed her $561,548.48 for a portion of the appeal work. Katherine argued that the estate is solvent and has “ample resources and much more than will be necessary to pay its anticipated expenses.” The executors have yet to respond on that matter and the court has still to take a decision on Katherine’s appeal against the processing of the secret deal.

Trials 2024

February 03 : Wade Robson and James Safechuck are now asking the judge to combine their cases and allow them to go to trial together. “This motion is made on the grounds that all actions arise out of the same type of harmful, abusive, course of conduct, by the same Defendants, at the same locations and physical places, in the presence of the same employees, employed by Defendants, during the same time period, in a pattern of abuse that was common to both Plaintiffs,” their lawyers stated in court documents. The trial conference on the motion is still set for February 28 before Judge Mark A. Young for the Robson’s case.

February 09 : Susan Yu was by the side of Thomas Mesereau during the 2005 trial and she has now joined the Michael Jackson Estate defense team against the Robson & Safechuck lawsuit.

February 15 : New court documents from the Estate vs Katherine Jackson case have emerged regarding the secret deal which is now obviously the sale of 50% of Michael Jackson Music Catalog (MIJAC) to Sony. Katherine has revealed that two of Michael’s children have objected to the deal. But despite the rebuttal, the judge granted the motion and approved the deal: “The proposed transaction is approved, and the executors are authorized and instructed to take all actions necessary to implement the proposed transaction, including but not limited to signing all contracts and performing all obligations required of the estate.” The executors were ordered to respond to Katherine’s appeal brief by January 30. No response was filed by the due date. The sale of the music catalog was announced on February 9. It’s unclear if Katherine and the executors reached a deal before the news of the sale was announced.

February 20 : The Estate agrees to let Robson & Safechuck combine their cases

Lawyers for Michael Jackson’s companies informed the court that they are agreeing with Wade Robson and James Safechuck’s plea to consolidate their lawsuits into one case. This motion to combine cases was filled at the beginning of the month. The Estate also requested to move the case to the Complex Litigation Program which means the case will move court location in Los Angeles.

February 28 : Pre trial hearing in the Robson case : No trial date set. Trial readiness hearing is June 5, 2024. Judge wants their reports by May 22, 2024. All other info I have to wait for. “A lawyer for Jackson’s companies said during the hearing that her clients plan to waive a three-year speedy trial rule because she believes the case won’t be ready for jurors until after December 2026. She said the trial likely would last more than 20 days with dozens of witnesses.” Estate is looking for December of 2026 or later for trial.

MJ Estate attorneys on discovery: “Before this case can be tried, there are numerous discovery issues and legal issues that need to be addressed, making it impractical to have this matter ready for trial within 12 months. …The deposition of third- party Charli Michaels remains open and needs to be completed. Robson’s deposition was also left open. As discussed below, however, there is extensive additional discovery needed as a result of Robson’s participation in the Leaving Neverland film.”

Wade & James express they are open to alternative dispute resolutions via mediation. This is common when hoping to reach a pre-trial settlement. (Contradicting their “we just want a platform to speak!”) The defense is NOT open to any ADR.

March 08 : According to court documents, John Branca and John McCain asked a California appeals court to reject Katherine’s recent petition. They said the proposed transaction could net the estate over $400 million. The executors asked the court to dismiss Katherine’s concerns. They said she had a history of objecting to deals they secured. McClain and Branca pointed to the concert film This is It! — which they said pulled in a $60 million advance and a substantial back-end for the estate despite Katherine’s objection to the project. Katherine testified that she did not like the deal. She said Paris and Bigi were on her side.

March 22 : Bigi Jackson doesn’t want Katherine to appeal against the Estate.

But on Monday, filed a court document saying that there is no point to appeal against the Estate. “It is readily apparent that a reversal on appeal would be an extreme longshot, given those odds, Bigi decided not to waste his resources to participate in an appeal. Nonetheless, Katherine has decided to appeal this court’s ruling. That decision is not for the benefit of the heirs.”In conclusion, Bigi has gave up the fight against the Estate and this court case might have damaged the relationship between members of the Jackson family.

March 23 : Thomas Mesereau has filed a 14 page questionnaire which will grill former Neverland Ranch Security Guard who previously claimed to have seen Michael Jackson touching accuser Wade Robson. Charli Michaels, former employee at the Neverland Ranch, claimed to have witnessed the inappropriate behaviour and came to light in 1993 during the Jordan Chandler trial.

March 26 : Katherine Jackson refused to back down from the Estate

After Bigi Jackson stated in court that he doesn’t think the Estate should pay for Katherine Jackson’s appear to the “secret” deal (MIJAC sold to Sony), Katherine Jackson is fighting back on the comment and against the Estate refusing to pay for her legal team. In her newly filed motion, Katherine said despite the executors’ claims her petition did identify the source from which the requested payment should be made. Her lawyer added, “It seems clear to her that the Executors are holding all of the assets in the Estate in order to keep control over them, and to avoid the more liberal distribution requirements of the Trust.” In addition, Katherine argued the estate is “currently holding something in the range of $1.5 billion.” She said, “this vastly exceeds its potential liabilities and leaves hundreds of millions of dollars available for the remainder beneficiaries.”

April 0: Filming for the MJ BIOPIC takes place at Wilshire Blvd – Center West Set.

The Estate is fighting to keep sealed photos of Michael from 1993 : Michael Jackson Estate is fighting to keep sealed court records out of the hands of Robson and Safechuck ahead of trial. Robson and Safechuck’s lawyers have subpoenas the county sheriff’s offices and the district attorneys of Los Angeles and Santa Barbara counties to obtain sealed police records from the 1993 case. The Estate believes that Robson and Safechuck’s are after those photos taken by the police.

May 25 : Robson & Safechuck’s trial potentially pushed to 2026

According to court documents, the Robson and Safechuck’s trial might be set to August 17, 2026. Depending on the judge’s confirmation on June 5, it seems that all parties are in agreement despite earlier reports that the “plaintiffs” wanted the court date to be before the release of the upcoming Michael Jackson Biopic next April. Court documents also showcase that Robson and Safechuck proposed a settlement stated that the Estate admit that Michael Jackson abused them during their childhood. However, the Estate’s team has no interest in settling saying those allegations are “unequivocally” false.

August 21 : It’s over for Katherine Jackson vs The Estate

After nearly two years of legal disputes concerning Michael Jackson’s estate, a Los Angeles court has ruled in favor of the estate’s co-executors, dismissing Katherine Jackson’s ongoing objections to a proposed catalog sale with a significant price tag. Katherine, 94, had repeatedly contested the decision after attorney John Branca and A&R executive John McClain, co-executors of Michael’s estate and trustees of the Michael Jackson Family Trust, secured a probate court ruling last year. This ruling permitted them to proceed with a reported $600 million sale of half of Michael’s music catalogue to Sony.

August 22 : Judge says no to use the precedent criminal case files

A California judge ruled in favor of Michael Jackson’s estate on Thursday (August 22), denying a request by accusers Wade Robson and James Safechuck to access “the entirety of the criminal file” related to child molestation allegations against Michael Jackson in Santa Barbara County and Los Angeles County dating back to the early 1990s. The request included photographs of Michael Jackson’s nude body and genitalia taken during a 1993 criminal investigation. Although the plaintiffs disagree with the structure of the discovery and motion schedule proposed by the defense, they have agreed to the defendant’s request for a trial date in 2026 or sooner, depending on the availability of the court and defense counsel. During an April 26, 2024, meet-and-confer, the defendants proposed a trial date of August 17, 2026. The plaintiffs did not object to this date or suggest any alternatives. The next court date is scheduled for October 22.

Frosty the Snowman

RECORDING DATE

Recorded in 1970 with The Jackson 5.

“Frosty the Snowman” is a popular Christmas song written by Walter “Jack” Rollins and Steve Nelson, and first recorded by Gene Autry and the Cass County Boys in 1950 and later recorded by Jimmy Durante in that year. It was written after the success of Autry’s recording of “Rudolph the Red-Nosed Reindeer” the previous year. Rollins and Nelson shopped the new song to Autry, who recorded “Frosty” in search of another seasonal hit. Like “Rudolph”, “Frosty” was subsequently adapted to other media including a popular television special.

Bottom of My Heart aka From the Bottom of My Heart

RECORDING DATE

The title “From the Bottom of My Heart” was first revealed through a 2005 post on 2seasrecords.com, stating it was going to be released as a charity single for the victims of Hurricane Katrina. However, the site was referring to another, completely unrelated unreleased song, “I Have This Dream”, and it is unknown why it was called “From the Bottom of My Heart”. It is presumed, that it was initially an alternate title for “I Have This Dream”, but the title got repurposed for the other song.

What came of “Bottom of My Heart” is an instrumental worked on around 2007 and 2008. The song was registered with the U.S. Copyright Office in 2010, listing Brad Buxer as the producer. Alongside other, thirty four titles, it became a contender for Jackson’s never-finished eleventh studio album.

“[…] Bottom Of My Heart is a totally separate song. The version I heard was an instrumental, and I was told by someone who worked on the music that MJ never got around to recording it. But it was on MJ’s list of songs he wanted to keep working on.”

For The World

RECORDING DATE

The track was registered with the U.S. Copyright Office in 2010. It credits Neff-U as the producer. According to Damien Shields, it dates back to “sometime from 1998 onwards” but doesn’t know which year specifically. Considering the producer, the song could’ve recorded or reworked between 2008 and 2009. It includes mumbled vocals and lasts 2 minutes.

“Starts with a beat which reminded me of “Free” from Bad 25 and “The Loser”. Lyrics: “Da da dadadada dee” (mumbling – includes the words “sun” and “trees” randomly) followed by “we do it for the world (x4)” followed by “alright” ad lib and some “ooo” vocals. […] According to my notes it has beat, sakers, bass and strings. It’s a light production. Not heavy. It has a similar, light, breezy vibe to the verses on “Free”. Lyrics mostly mumbled. It’s a demo. Ends after 2 mins when MJ stops the track and gives notes/instructions. That’s it […] Sometime from 1998 onwards. But I don’t know which year, sorry.”

For All Time

RECORDING DATE

“For All Time” was written by Steve Porcaro and Michael Sherwood and recorded in 1990 for the album Dangerous, although it didn’t make the cut.

“Michael had called and he wanted a follow-up, something that was in the vibe of Human Nature and obviously something from Steve. We wrote several songs and one of them was For All Time. He was going to put it on the Dangerous album indeed and it was supposed to be the ballad. Michael recorded it and it was coming out really well so we were really excited. But then there was this kid, Ryan White, who died of a blood transfusion contracting AIDS, and it was very sad. Michael had this beautiful song called Gone Too Soon and it had to go on the record. So it kind of knocked our song off the Dangerous record. We were hoping that maybe it would be on the next record, then we hoped it would be on the next record and then we finally just gave up on it and continued writing. At some point Lionel Richie was approached and he was interested to perform it. Steve told me that they did a track for him with Nathan East and some other people but I never heard it and it never surfaced.”
— Michael Sherwood revealed in an interview with Brice Najar

In the 2006, while working on Thriller 25, Jackson wanted to rework and include “For All Time” on the album, even though the song has nothing to do with Thriller album, era or sessions.

“Well, in 2005, maybe early 2006, we got a call from Michael saying that he was releasing the Thriller 25th anniversary record and that he would like to put For All Time on it. We were very surprised but we dusted it off and finished it up. It was 20 years later but you must never give up because you never know! It was a very pleasant surprise when Steve called me and said : « Are you sitting down? » I said : « No. » He said : « Sit down! » (laughs) Then I talked to Michael because I wanted to rewrite the verses. You know, 20 years later, I was a better writer so I said : « Can I please rewrite the verses? I love the chorus and the bridge, but I think the verses need a little more work. » But Michael said : « Oh, no, I want to keep it just like it is! » I said : « All right. » thinking to myself « You’re the King of Pop!… » (laughs)”
